Terms & Conditions

1. Introduction

Warmest welcome to all who are interested in learning and self-improvement. Thoresen & CO., (Bangkok) Ltd. would like to take this opportunity to introduce you to ThorConn.com’s services and Thoresen E-learning application. We are a provider of online courses specifically designed to systemically improve learners’ skills, knowledge, and abilities in international cargo shipping. With our supports, you can achieve professional expertise at the national and global level.

By signing up for the services of ThorConn website, Thoresen E-Learning application (collectively, “ThorConn Services” or the “Services”) or accessing to any content or information published by ThorConn via the “Services”, you agree to be bound by the Terms of Service of ThorConn, with details described below for your reference.

2. Definitions

Whenever used in these Terms of Service, the following terms and phrases shall have the meaning as specified below.

“ThorConn” means the provider of a specifically structured online course for systematic improvement of learners’ knowledge, skills, and abilities.

“User” means any individual who accesses the system of ThorConn for use of the Services, trial of the system or online course, or use of other ThorConn Services. “Member” means a user who has signed up with ThorConn.

“Content” means the content which is accessible through the Services in forms of data, such as text, audio file, music, image, video, software, program, computer code, and other similar forms.

“Additional terms and conditions” means any issued or uploaded documents in relation to the Services under headings “Terms”, “Practical Guidelines”, “Policy” or other similar headings.

3. Privacy Policy

“User” may read our Privacy Policy at http://ThorConn.com/dashboard/terms under Privacy Policy. If a User wishes for any or all usage information to be removed, this request for deletion of user data should be stated in a notice given to ThorConn in writing or in a manner specified by ThorConn. This Privacy Policy applies to use of all data collected from usage, including data gained via cookies. More details on the policy are provided in our Cookies Policy.  

4. Acceptance of Terms of Service

 “User” is required to accept ThorConn’s Terms of Service for access to ThorConn Services. The acceptance of these Terms of Service shall be in full force and perpetual effect and irrevocable.

5. Amendment to Terms of Service

ThorConn reserves the right to make changes to these Terms of Service and the Privacy Policy without prior notice and with immediate effect on and from the date specified in these Terms of Service, the Privacy Policy or a notice of amendment. The User will find updates on the amendments via channels provided to ThorConn or at the website under “ThorConn’s Terms of Service”. Unawareness of such amendments shall not be accepted as an excuse. ThorConn Services may be used only for personal learning of a User or a Member. In addition, User agrees that, without ThorConn’s consent, no Content of the Services may be copied, altered, or reproduced for any commercial purpose or financial gain.

6. Sign Up

By signing up with ThorConn, the “User” acknowledges and agrees that data of use of the Services, including enrolled course, access to the system, classes holding User’s interest, and other data relating to the Services may be collected and that ThorConn may use such data in accordance with the Privacy Policy without prior consent. In addition, no “User” may have access to, or request for, such data without ThorConn’s consent. The “User” is responsible for keeping secure username and password for access to ThorConn Services. ThorConn will deem that an individual accessing the system by using accurate username and password through an appropriate access channel is a “User”. In case of any use of Services provided by ThorConn, the User will not make any claim arising from use of the User’s username and password by someone else to access the system. The User will not allow usage, such as Content viewing, by any other User under the User’s member name or username. If such action is found, the User agrees that all certificates issued from ThorConn’s system shall be revoked and that no claim for any compensation will be made. 

7. Account Suspension or Termination

ThorConn may, in its discretion, suspend your account upon your request, or immediately and without prior notice if deemed necessary in any circumstance which may affect the use of your account, for example, in any of the following cases:

Use of your ThorConn account and/or ThorConn application services in a manner that does not, or is reasonably believed not to, conform with these Terms of Service;

Use of your ThorConn account and/or ThorConn application services in a manner that is, or is reasonably believed to be, in violation of the applicable rules, regulations and/or laws (including but not limited to laws on money laundering, fraud, or other laws in effect), or contrary to public order or morality;

(a) Loss, theft, or hacking of your electronic devices or login data;

(b) Order issued by any competent authority or under the provisions of applicable law or rules or regulation of the competent authority, financial institute, or court; and/or

(c) Other causes we deemed appropriate.

In this regard, if it is deemed that the situation or event causing the suspension of your Thorconn account has ceased to exist, we may terminate the suspension and give you a notice.

If your ThorConn account is suspended, you acknowledge and agree that you may not access your ThorConn account or use any of our services or products in accordance with the additional Terms of Service of such product (if any).

 8. Intellectual Property Rights

ThorConn respects intellectual property rights of our allied institutes. All content in communication channels, including but not limited to texts, pictures, data, comments, charts, databases, graphics, photographs, image, audio, or audio files, software, brands, and HTML are intellectual properties of ThorConn, our allied institutes, or Users (as the case may be) which are protected by the laws on copyright and trademark, and may not be downloaded, copied, altered, reproduced, printed, or distributed in any manner, except for download or printing for your personal use in accordance with the law and not for commercial or other purposes. Tutors or designers of the courses and ThorConn reserve the rights to suspend or terminate a user account that infringes copyright or trademark rights or other intellectual property rights pursuant to the Copyright Act B.E. 2537 (1994) and its amendments and other applicable laws on intellectual property. 

9. Privacy Policy

9.1) What is the purpose of data collection?

Personally identifiable information is any data that is used to identify an individual person in order to provide the Services, and must at least include name, email address, and information provided in the signup process.

9.2) What are uses of personally identifiable information

Services provision and use of website: Your personal data will be collected when you register the account in the website/application for use of our Services, such as enrolling on a course, contacting the system administrator, and accessing the course content. We will use User and/or Member’s personal data to ensure security of our website services.

Communication with our team: ThorConn will use your personally identifiable information to provide replies to questions or inquiries through email and other channels in accordance with the data usage policy. Your communications with us, such as link clicks through email, will be collected and used as reference for issuance of certificates and improvement of communication.

Updates: We will use personally identifiable information to keep you updated on our information or news through email. When you register in our system, you will be notified of updates, changes to the policy and Terms of Service in accordance with the laws.

Learning: We will use and send your class information, such as learning process, test results, assignments, and chat room conversations, to our team or administrator for appropriate checking and scoring of the assignments. In addition, this information will be used to assess the appropriateness of certificate issuance. 

9.3) Authentication

You must verify your identity in order to receive the Certificate of Completion from ThorConn. For premium classes, more personal information, such as identification card, passport, or photograph, will be collected. After the authentication is completed, your information sent to us will be deleted from the system (if any).

9.4) Research and Development

We will use general information, for example, occupation, age, gender, or education, and class information in the system, for example, test results, assignments, chat room conversations, and survey results, to develop the online course curriculum or other learning products in cooperation with our allied academic institutes.

9.5) Privacy Policy

Your personal information will be treated with priority. The accepted management and technology security measures will be adopted to protect your privacy from unauthorized access and inappropriate use. No personally identifiable information may be disclosed to any third party who is not specified in this Privacy Policy, except in the event that such disclosure is necessary to comply with the provisions of the laws, for example, threat to your personal safety.

We suggest that the highest level of caution be exercise to keep your login data secure and protected. Use of online system always has risks and we do not promise the security of your personally identifiable information against evasion of our security system or sniffing of your information transmitted through the internet by unauthorized third-party service providers and websites.

9.6) Which data is collected?

Three types of your personally identifiable information provided through our website will be collected as follows:

 - First, information provided by you, such as data provided when registering in the website or survey data.

 - Second, class information in connection with assessment, for example, your answers, assignments, test results or chat room conversation.

 - Third, automatically collected data, for example, web usage information and system data.

For registration of account in the website, when registering an account in the website or updating personal information for use of course enrollment function, or contacting us, data, including name, surname, age, gender, email address, and date of birth will be collected. For acceptance of certificate, upon passing the examinations of each enrolled class, you will receive the Certificate of Completion. ThorConn will use your official identification data, such as name, surname, address, and email address, for issuance and delivery of the certificate. For any inquiries on the certificate, please refer to the FAQ.

With respect to the survey data, we will occasionally provide surveys for learners on the website. The personal information will be used to identify the respondents, data to be collected, including occupation, education, source, and other data for improvement of the system and courses of ThorConn. With respect to customer support, the personal information, such as email address, will be used to verify your identify and provide replies to your questions and inquiries through the most convenient channel.

With respect to chat room data, ThorConn’s learning system includes chat rooms for questions and conversations. Learners must provide additional information to use the chat room of the website or a third party, such as Facebook, Line. The information to be provided includes your name and email address. Where our administrator or customer service staff will use this chat room to provide replies to questions and inquiries, or Services, we will use the personally identifiable information or other personal information to respond to your request submitted directly to us. However, no personal information of yourself or other persons may be posted in the chat room. For any inquiries on the practice guidelines, please refer to our Terms of Service.

With respect to class information, while taking classes in ThorConn’s online course, the class information, for example, learning process, test results, answers, assignments, and other information, will be collected and sent to our administrator for scoring and to the system for processing your improvement. This information will be automatically collected through the Learning Management System of ThorConn. As ThorConn adopts the Pre-requisite System for our courses, the class information is required for issuance of the certificate to learners.

With respect to Usage Information, when taking classes in ThorConn’s online course, the usage information and interaction between the system and learners will be automatically collected through the website and the Learning Management System of ThorConn. Information, such as click rate, page exits, session time, and other data will be used to improve provision of the Services through our system.

9.7) Update or Deletion of Personally Identifiable Information

 - You may access and verify the accuracy of your personally identifiable information. In case of any inaccurate personally identifiable information, you may make correction directly in the system.

 - You may submit a request to ThorConn for deletion of the information from the system within the specified period of time. Deletion of information will affect the right to receive the certificate, or the status of the previously received certificate. For any inquiries on conditions for receiving the certificate, please refer to this clause in the Terms of Service. In addition, you may refuse any information sent from us by contacting us for advice. Please submit the request for deletion of the information from the “ThorConn’s learning system” by sending the request over e-mail to Wanida@thoresen.com.
